1. Eligibility

To use Marty, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Platform under applicable laws
• Provide accurate and truthful information when creating an account

Certain categories (e.g., personals, dating) may require additional age verification. By accessing these categories, you affirm you meet all eligibility requirements.

2. Account Registration

• Account Security: You are responsible for maintaining the confidentiality of your password. Do not share your account credentials.
• Accurate Information: You must provide a valid email address and keep your account information up to date.
• One Account Per User: You may not create multiple accounts to evade bans or manipulate the Platform.
• Unauthorized Access: Notify us immediately if you suspect unauthorized use of your account.

3. Acceptable Use Policy

3.1 Permitted Uses

You may use Marty to:

• Post legitimate listings for goods, services, jobs, housing, personals, and other categories
• Search and browse listings
• Communicate with other users through our messaging system
• Report suspicious or harmful content

3.2 Prohibited Conduct

You may NOT:

• Post Illegal Content: Listings for illegal goods, services, or activities (drugs, weapons, stolen items, human trafficking, etc.)
• Engage in Fraud or Scams: Deceptive pricing, fake listings, phishing, advance-fee scams, counterfeit goods
• Harass or Threaten Users: Abusive messages, hate speech, threats of violence, doxxing, stalking
• Spam or Manipulate: Duplicate listings, keyword stuffing, vote manipulation, fake reviews
• Violate Intellectual Property: Unauthorized use of copyrighted images, trademarks, or brand names
• Scrape or Automate: Use bots, scrapers, or automated tools to extract data or post listings (without permission)
• Circumvent Safety Measures: Disable, interfere with, or bypass our AI moderation or security systems
• Impersonate Others: Pretend to be another person, business, or Marty staff

4. Listing Guidelines

4.1 Content Standards

All listings must:

• Accurately describe the item/service being offered
• Include a fair, realistic price (no "£1" placeholder listings)
• Be posted in the correct category
• Include original photos (not stock images or photos of different items)
• Comply with all local and national laws

4.2 Prohibited Listings

You may not post listings for:

• Illegal drugs, prescription medications, or controlled substances
• Weapons, firearms, explosives, or ammunition (except where legally permitted and verified)
• Stolen or counterfeit goods
• Adult services that violate local laws (prostitution, escort services in jurisdictions where illegal)
• Animals from illegal breeders or endangered species
• Hazardous materials without proper licensing
• Multi-level marketing schemes or pyramid scams

4.3 Content Moderation

All listings are automatically screened by our AI safety system. Listings flagged as potentially harmful, fraudulent, or violating these Terms may be removed or held for manual review. We reserve the right to remove any content at our discretion.

5. User Transactions

Marty is a Venue, Not a Party:

• We provide the platform for users to connect. We are NOT a party to any transaction between buyers and sellers.
• We do NOT verify the accuracy of listings, guarantee the quality of goods/services, or endorse any user or listing.
• You are solely responsible for evaluating the risks of any transaction and conducting due diligence.
• We do NOT process payments (users arrange payment directly). We are not liable for payment disputes.

6. Intellectual Property

6.1 Your Content

You retain ownership of content you post (listings, photos, messages). By posting, you grant Marty a worldwide, non-exclusive, royalty-free licence to:

• Display, reproduce, and distribute your content on the Platform
• Use your content for promotional purposes (e.g., "Recently Posted" sections, search results)
• Analyse your content with AI for safety and moderation purposes

This licence ends when you delete your content or account (subject to backup retention policies).

6.2 Our Content

The Marty brand, logo, design, code, and all Platform features are owned by us or our licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without permission.

6.3 Copyright Infringement

If you believe content on Marty infringes your copyright, contact us at dmca@Marty.example.com with:

• Description of the copyrighted work
• URL of the infringing listing
• Your contact information and signature
• Statement of good faith belief that use is unauthorized

7. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

We disclaim all warranties, including:

• Merchantability, fitness for a particular purpose, and non-infringement
• Accuracy, reliability, or completeness of listings or user content
• Uninterrupted, secure, or error-free operation of the Platform
• Safety or legitimacy of transactions between users

You use the Platform at your own risk. We do not guarantee that our AI safety systems will detect all scams, fraud, or harmful content.

8. Limitation of Liability

To the maximum extent permitted by law, Marty and its affiliates, officers, employees, and agents shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use or inability to use the Platform
• Transactions with other users (fraud, scams, non-delivery, etc.)
• Unauthorized access to your account or data
• Errors, bugs, or downtime
• Content posted by other users

Our total liability to you for all claims shall not exceed £100 USD or the amount you paid us in the past 12 months (whichever is greater).

9. Indemnification

You agree to indemnify, defend, and hold harmless Marty from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your listings or content
• Your transactions with other users
• Your violation of any third-party rights (copyright, privacy, etc.)

10. Termination

We may suspend or terminate your account at any time, with or without notice, if:

• You violate these Terms
• We suspect fraudulent, illegal, or harmful activity
• Required by law or legal process
• We discontinue the Platform

You may delete your account at any time from your account settings. Upon termination, your right to use the Platform ceases immediately.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

11.2 Arbitration

Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration (not in court), except for claims that may be brought in small claims court.

Arbitration will be conducted by [Arbitration Organization] under its rules. You waive your right to a jury trial or to participate in a class action lawsuit.

11.3 Exceptions

Either party may seek injunctive relief in court to protect intellectual property or confidential information.

12. Changes to These Terms

Continued use of the Platform after changes constitutes acceptance of the updated Terms. If you do not agree, stop using the Platform and delete your account.

13. General Provisions

• Entire Agreement: These Terms (along with our Privacy Policy) constitute the entire agreement between you and Marty.
• Severability: If any provision is found invalid, the remaining provisions remain in effect.
• No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
• Assignment: You may not assign these Terms. We may assign them to a successor entity.
